Terms of Service

1. Agreement to Terms

By accessing or using the UzioMeme ("Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.

The Platform is operated by the Centre for Data Science and Artificial Intelligence at Dedan Kimathi University of Technology ("DSAIL", "we", "us"), in partnership with Ol Pejeta Conservancy and National Geographic.

2. Description of Service

The Platform provides the following capabilities:

• Real‑time visualisation of electric fence node voltage (kV) and battery status on a satellite map.
• Historical voltage analytics and fence profile charts per node and per group.
• Automated email alerts when node voltage falls below configurable thresholds.
• Gateway location tracking for LoRaWAN network infrastructure.
• Integration with live weather data relevant to field operations.
• Water sensor analytics for conservation site monitoring.
• An administrator interface for managing nodes, calibration, and access control.

The Platform is a research and operational tool deployed for conservation purposes at Ol Pejeta Conservancy. It is not a general‑public consumer product.

3. Access and Accounts

3.1 Eligibility

Access to the Platform is by invitation only. You must be at least 18 years old and authorised by DSAIL or Ol Pejeta Conservancy to create or maintain an account.

3.2 Account Security

Authentication is handled via Google OAuth 2.0. You are responsible for maintaining the security of your Google account and for all activities that occur under your credentials. Notify us immediately at dsail-info@dkut.ac.ke if you suspect unauthorised access.

3.3 Roles

• Administrator: Can add, edit, and remove fence nodes; manage calibration offsets; grant or revoke access to other users; and configure system settings.
• Viewer: Can access live map, analytics, fence profile, water analytics, and weather pages in read‑only mode. Cannot modify node configuration or user access.

3.4 Account Termination by Us

We reserve the right to suspend or permanently revoke any account, at our sole discretion, without notice, if we reasonably believe the account is being used in violation of these Terms or applicable law.

4. Permitted Use

You may use the Platform only for its intended purposes: monitoring, analysing, and managing the electric fence infrastructure at Ol Pejeta Conservancy for wildlife conservation. Specifically, you agree to:

• Use the Platform only in accordance with these Terms and all applicable laws and regulations.
• Keep any credentials, API keys, or secret tokens assigned to you confidential.
• Report any anomalies, security vulnerabilities, or system errors to dsail-info@dkut.ac.ke promptly.

5. Prohibited Use

You must not, under any circumstances:

• Attempt to gain unauthorised access to any part of the Platform, its infrastructure, or data.
• Reverse‑engineer, decompile, or disassemble any component of the Platform.
• Use automated scripts, bots, or scraping tools to access data beyond normal platform use, without express written permission from DSAIL.
• Interfere with or disrupt the Platform's servers, networks, or connected sensor infrastructure.
• Introduce malware, viruses, or any malicious code.
• Impersonate another user or misrepresent your identity or affiliation.
• Use the Platform for any commercial purpose not expressly authorised by DSAIL.
• Share, publish, or redistribute raw sensor data, system credentials, or internal configuration without the prior written consent of DSAIL.
• Use the Platform in any way that could compromise the security or integrity of the electric fence, thereby endangering wildlife or human safety.

6. Alert System — Disclaimer

The Platform includes an automated email alert system that notifies designated recipients when fence node voltage drops below a configured threshold. You acknowledge and agree that:

• Alert delivery depends on third‑party email infrastructure (Resend) and internet connectivity. Delivery is not guaranteed.
• The alert system operates on a polling interval (approximately every 5 minutes via an external cron service). There may be a delay between a fault occurring and an alert being sent.
• The Platform is a supplementary monitoring tool only. It does not replace physical inspections, on‑site security personnel, or any other safety system.
• DSAIL is not liable for any harm — to wildlife, property, or persons — arising from delayed, missed, or erroneous alerts.

7. Data Accuracy

Voltage readings, battery percentages, GPS coordinates, and other sensor data are derived from physical LoRaWAN devices subject to environmental interference, calibration error, and network packet loss. We make no warranty that any sensor reading is accurate, complete, or current. Always verify critical readings with on‑site inspection before taking operational decisions.

8. Intellectual Property

The Platform's software, design, visual assets (including logos and branding), and documentation are the intellectual property of DSAIL and its contributors, protected by applicable copyright and intellectual property laws. You are granted a limited, non‑exclusive, non‑transferable licence to use the Platform solely for the purposes described in Section 4.

The DSAIL, Ol Pejeta Conservancy, and National Geographic names and logos are trademarks of their respective owners. Nothing in these Terms grants you any right to use these marks.

9. Disclaimers of Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. DSAIL DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR‑FREE, SECURE, OR AVAILABLE AT ALL TIMES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DSAIL, OL PEJETA CONSERVANCY, NATIONAL GEOGRAPHIC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, DSAIL'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless DSAIL and its partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any applicable law.

12. Availability and Maintenance

We aim to maintain high availability but do not guarantee any specific uptime. We may perform scheduled or emergency maintenance at any time. Where possible, we will provide advance notice of planned downtime to authorised users via email.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall first be subject to good‑faith negotiation. If unresolved within 30 days, disputes shall be referred to the courts of competent jurisdiction in Nairobi, Kenya.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the effective date and, for material changes, notify authorised users by email. Your continued use of the Platform after the effective date of any revision constitutes your acceptance of the updated Terms.
